Members considered the 2 public interest tests certificate from the Proper Officer and concluded that on balance the public interest in maintaining the exemption outweighed the public interest in disclosing the information and it was

 

RESOLVED that in accordance with Section 100A(4) of the Local Government Act 1972 the public be excluded from the remainder of the meeting because of the likely disclosure to them of exempt information as             identified in paragraph 12 of Part 4 of Schedule 12A of the Local Government Act 1972.

LICENSING OF HACKNEY CARRIAGE /PRIVATE HIRE VEHICLE DRIVERS.

Minutes:

The applicant Mr E failed to attend the Sub Committee.  The Licensing Manager assured the Sub Committee that several attempts to contact the applicant had been made via email and telephone but to no avail. A message was left on the applicant’s answer phone by the Licensing Manager further informing him of the time and date of the hearing. 

 

The Sub Committee retired to make a decision on whether to defer the application or to proceed in the applicant’s absence. 

 

The meeting reconvened with it determined that in light of the fact that several attempts had been made to contact the applicant and the fact that the applicant had gone through this process in October 2019, the hearing would proceed to consider the application in the applicant’s absence. 

 

Having regard to the Officer’s report and all the representations made, and for the reasons disclosed at the meeting, the Sub Committee unanimously RESOLVED that the application for the grant of a hackney carriage/private hire vehicle driver’s licence be refused.

 

The Licensing Manager will inform the applicant of their right of appeal within 21 days following receipt of the written decision notice to appeal to the local Magistrates Court.

 

5.

Minutes:

Having regard to the Officer’s report and all the representations made, and for the reasons disclosed at the meeting, the Sub Committee unanimously RESOLVED that the application for the grant of a hackney carriage/private hire vehicle driver’s licence be refused.

 

The applicant was informed of their right of appeal within 21 days following receipt of the written decision notice to appeal to the local Magistrates Court.

 

            The meeting closed at 12:36 p.m.
