Apologies for absence were received from Councillors J. Bevan, P.J. Bevan, D. Cushing,

Ms J. Gale and W. Williams

Declarations of Interest.

There were no declarations of interest received at the commencement or during the course of the meeting.

Licensing & Gambling /Registration/Permit Fees - 2019/20, and Amendment of Licensing & Gambling Sub Committee Hearing Procedure. pdf icon PDF 551 KB

Minutes:

Consideration was given to the report which recommended amendments to Gambling fees and advised Members of the fee structure established by the Government under the Licensing Act 2003.  The report also sought to amend the Committee Hearing Procedures in relation to speaker order.

 

            Members were referred to Appendix 1, Appendix 2 and Appendix 3 of the report which detailed the proposed Premises Licence Fees for 2019/20, Permits and Associated Charges for 2019/20 and Main Fees (set centrally by Government) respectively. Members were askedto implement fees with immediate effect.

 

            In relation to Hearing Procedures the proposed change would enable Members to hear from the applicant prior to hearing the comments from Responsible Authorities and Interest Parties.

 

            Clarification was sought regarding the summing up process for the various parties and whether it would be possible under the amended procedure to go back to the applicant at a later stage.  Officers confirmed that ‘summing up’ would continue and advised that further questions could always be asked at the discretion of the Chair.       

 

            Members welcomed the change in procedures and agreed that it would enhance the hearing process.

           

Having fully considered the Officer’s report, it was moved and seconded that the recommendations contained therein be approved.  By a show of hands this was unanimously agreed.

 

RESOLVED that: -

 

(i)         the level of fees proposed under the Gambling Act 2005 for 2019/20 as outlined in Appendix 1 and the Temporary Use Notices as detailed in Appendix 2 be approved;

 

(ii)        the level of charges in connection with the Licensing Act 2003 as set out in Appendix 3 and for the majority of Gambling Permits and associated charges  as outlined in Appendix 2 be noted;

 

(iii)       the amendment to the Sub Committee Hearings procedure relevant to Licensing and Gambling Sub Committee as set out in Appendix 4 be approved.
